Welcome to Synexa ("Synexa," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of synexa.art and any related applications, tools, APIs, and services (collectively, the "Service"). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility & Accounts

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized access.

2. The Service

Synexa provides AI-powered image and video generation tools, prompt engineering utilities, and related media features. Outputs are produced by third-party machine learning models and may vary in quality, accuracy, and appropriateness. We do not guarantee specific results.

3. Credits & Payments

The Service is credit-based. You purchase credit packs through our payment processor (Stripe). Credit costs per action are displayed in-product before you confirm. Credits:

Are non-transferable and non-refundable once consumed (see §10).
Have no cash value outside the Service.
May expire if your account is inactive for an extended period (we will provide reasonable notice before expiry).

4. Acceptable Use

You agree not to use the Service to create, upload, or distribute content that:

Depicts minors in a sexualized manner (CSAM) — this is a permanent ban and will be reported to authorities.
Depicts identifiable real people in sexual, defamatory, harassing, or deceptive contexts without their consent.
Infringes intellectual property rights, including by reproducing copyrighted characters or trademarks for commercial use.
Promotes violence, terrorism, self-harm, or illegal activity.
Attempts to bypass rate limits, scrape the Service, or extract model weights, prompts, or system instructions.
Probes the Service for vulnerabilities outside a coordinated disclosure.

We may suspend or terminate accounts that violate these rules and may remove any content at our discretion.

5. Your Content & Outputs

You retain ownership of inputs you upload (reference images, prompts). Subject to applicable law and the limits of model licensing, you own the outputs you generate, and may use them for personal and commercial purposes. You grant Synexa a limited, worldwide, royalty-free license to host, store, and process your inputs and outputs solely to operate and improve the Service.

6. Third-Party Services

We rely on third-party providers (e.g., Stripe for payments, model providers for inference, cloud infrastructure). Your use of those providers' services through Synexa is also subject to their terms.

7. Service Availability

We strive for high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features at any time. Where reasonably possible, we will notify users of material changes.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SYNEXA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO SYNEXA IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

11. Termination

You may close your account at any time from Settings. We may suspend or terminate your account for breach of these Terms, prolonged inactivity, or legal compulsion. Sections that by their nature should survive termination will survive (e.g., IP, disclaimers, limitation of liability).

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced via email or in-product notice at least 7 days before they take effect. Continued use after the effective date constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of Sweden, without regard to conflict of law principles. Disputes shall be resolved in the courts of Stockholm, Sweden, unless otherwise required by mandatory consumer-protection law in your jurisdiction.
